Witness and Testimony Research identifies a witness strengths and weaknesses and provides counsel with an assessment of both the content of the message and the credibility of the messenger. Most important, this research identifies the extent to which a witness impacts on the outcome of the case.
A mock judge or jury is presented with a brief, videotaped overview of the case, followed by a realistic direct and cross examination of one or more witnesses.
At strategic points in the exercise, the panel responds to a questionnaire that measures perception of the witness testimony and overall credibility.
After hearing the case summary and examination of the witnesses, the panel retires to deliberate. Counsel is invited to observe deliberations through a one way mirror.
Once a verdict has been reached, LGA Litigation Strategists staff conducts a discussion with the panel. Additional information is gathered on issues concerning the witnesses and their testimony that were distorted or ignored during deliberations.
Deliberations are filmed and analyzed in detail. Counsel is provided with an overall assessment of the case, together with practical recommendations for increasing witnesses credibility and strengthening the most vulnerable areas of their testimony.
