High & Low Damage Juror Profiles

High and Low Damage Juror Profile research assists counsel in prioritizing peremptory challenges during jury selection by identifying the characteristics of strongly committed jurors.

The data to be analyzed can be collected as part of the research design and data collection procedures used in Deliberation Analyses or a Trial Simulation, during which jurors complete an extensive questionnaire that focuses on their preexisting biases, knowledge, experience and beliefs related to the case. Depending on the nature and extent of our research efforts on a case, these data may be supplemented with questionnaire data gathered from individuals who are recruited to view or read summaries of the case and who then fill in a questionnaire detailing their response to the case and the attitudes and biases that underlie their reaction. To ensure statistical reliability of the findings, we recommend a sample size of at least 400.

Sophisticated statistical techniques will be used to identify the combination of characteristics associated with a strong commitment to the case. If counsel has ample opportunity to question prospective jurors, emphasis will be placed on the subtle psychological, attitudinal and lifestyle characteristics of the high and low damage juror, as well as on identifying visible traits that are easily recognized during jury selection in Federal Court.
